Truck Driver Error
Federal Motor Carrier Safety Administration (FMCSA) regulations are in place to govern the hiring, training, and operation of commercial trucks. The regulations are designed to increase the safety for everyone sharing the road with big trucks. Unfortunately, the FMCSA cannot strictly enforce the regulations, and truck drivers routinely avoid weigh stations and check points. The result is that many collisions are caused by truck drivers who are too tired, improperly trained, or in too much of a hurry to reach their destination.
For more than thirty-five years, Tabor Law Firm has been helping people recover compensation after being seriously injured in truck accidents on our Indiana highways caused by truck operator error. Truck drivers who drive too fast, drive drunk, or simply fail to follow emergency stopping procedures are a danger to others on the road, as well as themselves. It is estimated that more than 900 people will be killed in accidents on Indiana roads this year, including scores killed in side swipe, ride under, and head on collisions resulting from truck driver negligence and mistakes.
Case Study
Cole v. TruGreen/Leisure Lawn
Our client Gary Cole, suffered serious injuries requiring multiple surgeries when the driver of a TruGreen/Leisure Lawn truck made a left-hand turn in front of Gary as he was operating his motorcycle on Pendleton Avenue in Anderson, Indiana. The force of the collision catapulted Gary over the truck and sent him thirty feet into the air before hitting the ground. The truck driver admitted that he did not see Gary before he turned. Due to the severity of his orthopedic injuries, as well as a traumatic brain injury, Gary missed many months of work. Tabor Law Firm represented Gary and helped him to recover an amount from Defendants that compensated Gary for his injuries and his lost wages.
